Insurance renewal and problem with NCD

Hi,
My car was hit in April last year and no fault of mine. Went through my insurance company and had repairs done etc.
The case between the insurers is still ongoing even though my insurer told me many months ago the other parties insurance company have accepted responsibilty (and separately the other insurance company have also told my solicitors they accept responsibilty and made an offer for injuries sustained in the accident).
My problem is that my insurance is now up for renewal but because this incident is still apparently ongoing, they will not give me my full no claims bonus and don't know how long it will take to resolve. That means my premium is going to be over £400 higher than it should. Is there anything I can do to get my full NCD at the start?

Seems strange. Ask them if this has been looked into and the hike in premium set by an Underwriter. If so, state your case and ask them to look at it again.
Seems strange they have made a decision like this if what you say is accurate.
The problem with open and ongoing claims at renewal is that if not settled it is hard to go to another insurer as they often tell you to get lost.0 -
Well the broker (Kwik Fit) went through to the underwriter and told me it is still ongoing. I plan to speak to the underwriter directly and find out what is going on.
Seems strange that if the other insurance co accepts responsibilty to my solicitors and makes an offer for injuries, it could say something different to my underwriter (my mistake above, my underwriter only told me they were claiming back from the other party a few months ago).0
