Phones arrives Dead on Arrival, yet I still have to pay line rental?

Hi,
Just bought a Nokia N900 and on arrival the microphone does not work. Spoke to Nokia who've told me to return the phone.
Sent an e-mail to T-Mobile asking them to temporarily close the account whilst I'm having the repaid and they've told me that they can suspend the account but I'll still have to pay line-rental!
Sureky this is not right, since the minute I've had the phone it's not been fit for purpose! Surely they cannot charge me line rental.
The phone was bought through mobilephones direct and not T-Mobile directly if that makes a difference.
Any help appreciated!
Thanks!

your issue is with mobilephones direct t-mobile did not supply you with the phone so they are not responsible if it breaks down.
you could chase mobilephones direct for some sort of goodwill gesture0 -
Phone and line contract are separate. You put the sim in another phone and still use the line (they'll say).0

Indeed that is what the operator will say.
Your cause for complaint will have to be you paid for a service you couldn't use, or you had to at your expense acquire another phone until you received a working one. Either way you chase the retailer not the operator as they are still providing you a signal.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -
