Wife started new job.. but agency says its not their responsibility to send P45...???

Hi all,

My wife has just started a temporary job for 2.5 months or so.. has her previous P45 from old employment and was out of work for approx 2 months. I've been reading P45 and it looks pretty clear you are supposed to give it to your new employer once you start employment so they can sort out your correct tax code.

However the agency... said its not their responsibility to do this.. So two questions.

1. Is it their responsibility or not? Because its temp work does it mean it isn't their responsibility?
2. If it isnt their responsibility where should my wife send it?

    It entirely depends. Is she employed by the agency or did they simply introduce her.

    They are probablyrefusing to use it because it's over 6 weeks old, and this could mean your wife would be paying tax incorrectly, if "old" figures are used.

    As long as she has filled in a P46 instead then the tax office will write to the agency with the figures to use within the next few weeks, as her old employer will have sent their part to the Tax Office when they issued it.

    What rubbish - of course its their responsibility - it doent matter how old it is. Its the employer's duty to operate PAYE on her pay and part of this process is to receive the P45 from the employee. They sound like a dodgy lot to me.

    Not necessarily.

    Did the OP's OH submit their P45 immediately, how old is it? When did she give it to them? Has she completed a P46 in place of the P45.
