Unreturnable/unrefundable policy for BlackBerry within 4 days of purchase?
Hello,
I bought a BlackBerry Pearl 8110 in a Carphone Warehouse shop 4 days ago. Since then, I realised I'm not a "Blackberry person" at all and since I haven't unpacked it nor used it, I decided to bring it back to the shop yesterday, assuming I could do so using the standard "7 day return/refund policy".
The manager told me that they were "sorry to be unable" to take it back for this specific model/offer because it was a special deal* and because BlackBerry had a special agreement with T-Mobile to refuse returns/refunds.
Is this legal at all?
Since I wasn't told about that when I purchased the mobile phone, surely there should be a way around it, unless the manager fed me porkie pies in the first place...
I feel gutted and cheated. Could anybody with sound expert knowledge help please?
*special deal = £89.95 for the device as PayAsYouGo + £10 calltime = free Internet browsing & emails for a year

There is a 5/7 day returns by law if ordered online, but in the shop there is no return policy defined by law, as soon as you sign/buy you are agreeing to it.
As you purchased from carphone warehouse you abide by their rules, not T-mobile and if no special terms were made clear at the time of sale then the standard returns poilcy should apply. Such as if you buy damaged clothes or sale items, you have to be told at the till items are not returnable.
However looking up the standard return policy, there is no return period and by purchasing you have agreed to this.

The only rights you have are your statutory rights, so under sale of goods if it is faulty they must replace, repair or refund.
Another option is to sell the phone on Ebay at a loss but atleast recover some money back.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0
