!! SOOOO Annoyed!!! **Rant warning! and a long one at that!*

Ok - as you may remember my OH has debts - they was £32,000. We set up payments and arrangements, fired letters etc, managed to get them down to £13,000.

Sent all debt collecters an updated expenditure form, all fine.

Got a letter from a company asking "Mr X XXXXXX to contact As soon as poosible"

Now this is a collector i do not recognise (they are legit, just not one we have been dealing with) so i looked at the address and it is the same building as Equidebt (now we DO deal with these) So i gave them a call (I know i know!) to see what it was about. Apprently, they are the same company, but i can not speak to them as OH only authorised me to speak to Equidebt!! OH rings up and authorises me, so i then ring back.

Usual garb "name, DOB, address" to get through security.

DOB is wrong - Obviously IM not getting his DOB wrong - they are!

So, correct name, Correct Address - well kinda, an old address was where debt came from - wrong DOB. Debt collector then slips up and says its x2 credit cards with Abbey. OH SWEARS he hasnt got anything with abbey - I KNOW he hasnt, hes on my bank account - So we highlighted fraud.

Rang Abbey - They can not speak to me (or OH) as it "will breach data protection" - WHAT?? They are protecting the jerk who has ripped of OH's ID!!! how ridiculous! They wont tell us when the cards were taken out (Old address, we havent lived there for 4 years) and wont tell us amounts or naff all! They can only tell us that it was a "recent event"

Called police. Apprently, And i was fuming at this, they are assuming that it is OH's debts because "he has informed us that he does in fact have outstanding debts" - YES! ones we have been paying off for the past 2 years you moron!!

Police finally said they will investigate "should abbey wish us to" but that they could arrest OH for "wasting police time"

WELL! they dont seem to be doing much policing in our area anyway so what time are we wasitng? ??

Can anyone think of anything else we can do other than provide passport for DOB info - Rent book for proof of address? (old address we needed to pay to have locks changed so we have asked for the reciepts of these)

So angry (and sorry for the rant!)

    Just some advise: Ask for a Subject Access Request (SAR), which includes the original signed Consumer Credit Act 1974 agreement which was signed (so they claim) by your OH. If they can't provide that, then tell them to fob off as it won't be enforcable without the signed CCA agreement :)

    i know how you feel about the data protection of the people who used your husband's details to get credit cards!

    this is a different situation, but last month, i noticed £200 worth of transactions on my online statement that i didn't make. i contacted the bank and got them to cancel the card - it was a debit card (i still had it so someone just stole my details) and so they 'investigate' before they give you your money back.
    i could obviously see where the money was spent so i called one of the companies - interflora - to see where the payment has originated from or where the flowers were delivered. i didn't even want to know the full address, all i wanted to know was whether it happened on the isle of man or not - given that our police only has jurisdiction over here. they couldn't tell me because of data protection - apparently you need to go to the police first and they need to issue a request.
    i went to the police anyway - must say the guy i spoke to was a lot nicer than the one your husband had to deal with (then again, our police and government workers are always really nice - nowhere near as stressed as in the uk) - he wrote everything down and said they would investigate if the bank asks them to but he was pretty certain that they wouldn't do for £200 as it would cost them more to investigate it.
    i did give my money back - even though it took a couple of weeks, i'm just happy i noticed it before they could spend thousands.

    i'm sure you'll manage to sort this out, especially if they don't even have his dob right! good luck!

    Ignore any future letters from them about the debt - keep ignoring it and if it crops up on your OHs credit file immediately contact the agency to have it removed.
    If you want to make fraudsters life diffucult then put a notice on his credit files :)

    Police won't deal with this until abbey report it to them. This is true. Might sound odd but the banks have their own investigation to do first
  • ok - I got a credit report from Experian for OH.

    I got a loan out before my OH joined my bank account, on his report my loan is showing

    BUT

    None of his other debts are?

    The only mention is one default which says "default 8 times" but this company is one we have been paying every month for a year and a half?!

    Any ideas?

    It COULD be that there is a duplicate account for him with incorrect details :confused:
    Also the defaulted account - you say you have been paying but is it the full contracted amount you originally agreed to? If it's a reduced amount then the defaults are correct as you have defaulted on the original contract.

  • the creid was from PC World - Which OH defaulted - it when to TBI Finance and we have an agreement with them to pay xx amount a month - which we have been doing.

    Surley the default should be PC World and not TBI ? :confused:

    No if another creditor has bought the debt they can and should change the details to them - what they can't change is the date the default was originally placed on his credit file. If they have altered that then contact them to get it changed to the original date as this is the date that starts the 6 year count down for the default dropping off his files :)
