Old Credit Card Charges come back to haunt

Back in 2004 I got a capital one credit card with a credit limit of £200. After a couple of weeks the card was maxed out and I statred paying the minimum payments, I missed a couple of payments however and because the charges back then were circa £35 for late payment and £35 for overdrawn, after interest I was getting £75 added onto the balalnce per month and I soon racked up around £700 debt on the card. I was still making payments when possible off the balance af around £20-£40 when I could afford it ( i was at Uni so skint!) but because of the charges the amount of debt was still going up.

So after around 18 months of this I phoned them and I'd paid around £500 off a initial balance of £200, at this point the regulations for card charges were changed and many people claimed all of their charges back successfully I told them that I would not be payong anymore, they had already received £500 and that if I did pay them then I would just claim it back from them so they would end up owing me. After a couple of nasty calls from the collections dept. they seemed to get the hint and I thought they'd cut their losses and wrote off the rest of the charges.

Then the other day I receive a letter from McKenzie Hall a notorious debt collector and after I contacted them they say I owe them £800 for the capital one account so my question is this; If I pay the settlement fee to McKenzie Hall can I still claim back all the charges that capital one have levied on me including the ones I refused initially to pay for. i.e. would the payment I make to the DCA still count as charges from capital one and can I claim them back.

I think the debt has been purchased from Capital One by the DCA so this might mean I can't claim them. Any advice?? Hope this makes sense.

Paul
