Credit card purchase refund

Hi guys, can any of you help?

It's my other half's 40th b'day in Jan and I've booked for us to go to Las Vegas for 4 nights through Expedia and paid on my Mint Credit Card. We usually have annual travel policies but mine has expired and I was holding off until nearer the time to renew it.

Here's the problem. Since making the booking I have been diagnosed with Cancer and am now undergoing chemo and radiotherapy - hence not able or fit to travel. Expedia have said that the package I booked is non transferrable and non refundable but that I could apply for a refund of the tax element of the flight ticket (about £80 per ticket.)

I've paid about £1200 for the trip (flights & accomm) and whilst my health is more important than anything, some kind of refund or being able to change the travel date would be a nice sweetener and something to look forward to whilst the treatment is going on.

Does anyone have any idea how we stand on this?

  • Sorry to hear about your illness but lets cut to the chase. You have no insurance so you have only 2 options that I know of. First off you need to get in touch with Expedia Customer Service/Relations by letter explaining everything and hope as a goodwill they will buckle to either refund or transfer. 2nd check with Mint they may be able to help with section 75 although if Expedia are acting as the agent for airline/hotel then i don't know until you provide more details about your holiday i.e. its was booked as a package? or its seperate flights and accomodation? A package would be covered by ATOL also.
    Credit card and overdraft at 18. 2 loans and 3 storecards at 20. University education flushed down the toilet through debt at 22. Car finance at 23. Car repossessed at 24. Rock bottom at 25. Learnt my lesson 26-33. Now 34 with a mortgage on an affordable house, a car paid for with cash and a bank account in credit. I learnt the hard way.

    When did you book? I assume the trip is January 2010.

    I think you'd be looking for a goodwill gesture from the company. They are owned and staffed by real people so they can on occasion be flexible.

    You'll need to post full info on the situation so people can comment.

    I agree with the other comments. It's a tough time for you I'm sure, but I don't think you're covered legally as there is no problem with the product you've purchased as such; it's that you're unable to use it.

    I would definitely write to them, and look for a goodwill gesture, as this is the only route to take as I see it.

    Regards to right of refund, unfortunately you don't have one. The norm, for holiday firms is along the lines of the following:
    If you cancel your holiday you will usually lose your deposit or pay a cancellation charge. This may be almost the full cost of the holiday. This is because you will have broken the terms of the contract you made with the holiday trader when you booked your holiday.

    The contract will usually say whether a cancellation fee has to be paid. If so, the amount given will usually be binding. If the contract does not allow cancellation, you will be liable for any losses, which the holiday trader might have incurred.
