Hi I spent the last 20 months in hospital with a virus and so have been off work, after great advice from people on here and welfare rights I asked my company about my holiday pay entitlement, I sent a Grievance in and attended the meeting on Friday where they agreed I should receive my holidays from this year but said they would need to speak to a solicitor regarding last years as they dont think I should be paid for them, I am just wondering if anyone out there knows if I am or not entitled...by the way just to add due to my illness and stay in hospital i can no longer work again

Does your contract state "use it or lose it" in regard to holiday?0

And does it specify whether you do or do not accrue holiday entitlement when on sick leave? All contracts I have had say you do not accrue holiday when on long term sick leave.

This link has info regarding a ruling earlier this year that means you can accrue holiday while off sick, not sure if it can be backdated though if your policy stated you couldn't before this ruling went through.0 -
I think you will find that holiday pay is an entitlement, and as such you will get it.....Of course I’m no expert.0
