Debitas

Hi all. Long time reader, first time poster.

I've seen other Debitas threads, but dont want to resurrect an old one (althoguh if I should have done, please forgive me!).

Crapital One have passed on my outstanding balance to Debitas. After speaking to them last week, they offered me a settlement figure of £230 (instead of the £370 they think I owe). I said I would call back by the end of this week after I had thought about it (needed some time to shuffle some finances). Got a letter today telling me that I hadnt made contact with them, and that they were going to start the harrassing phone calls (Ok, I paraphrase!). I've spoken to them today and asked why they have lied in their letter to me, as I clearly called on the 4th November. They apologised and said that the reduced offer still stands. I offered to pay half (£115) next week and the other half next month (on payday). This wasnt acceptable to them, so I suggested that after I've paid my other debts, I could instead make a pyment of £10 a month starting Jan 2010. This also wasnt acceptable. I then spoke to a manager, who was quite helpful and told me to call back on the 21st, when I could set up the 2 payments of £115. He did say that if I didnt call back they'd pass it over to another agency. I just told him that I'd dispute the debt and it would get referred back to them, to then be paid £10 a month.

From others experience - am I likely to call next week and find that the offer of £230 has suddenly vanished? Surely it is in their interest to get it closed down as quickly as possible?

    I think you need to get confirmation in writing that your payments to make up the £230 will be in full & final settlement of the debt, otherwise they may take this money and then start to chase for the remainder (either soon after or for up to 6years).

    No, I havent. TBH Im happy that I owe what they say I do - I havent made any payments to them for several months, and had worked out (prior to getting a letter from them) that I owed about that much. I did ask for written confirmation but they said they were unable to do it. I will be writing to them anyway concerning a couple of issues, so will ask for that confirmation!

    Don't do anything without written confirmation, or if they say they can't write, ask them to hold while you record the phone call. Make sure that you get all details, name, position in company etc. If they try and wriggle then you should assume that its not an honest answer.

    bear in mind that debitas probably paid a few pence in the pound for this debt, so if you pay them £100, they will still make a profit.

  • My parents have started to receive calls from Debitas, asking for a person who they do not know and who has never lived at their address (they have lived there for 40 years and this person has never lived there). They are calling on behalf of Capital One. My parents (lucky things) have never had even one credit card and never been in any debt in their lives. The thing which is making it more distressing than ever is that my father has been diagnosed with a terminal illness and has a short time to live. This is such a traumatic time for them both that they do not need the added stress of Debitas being extremely rude and brash when (for the 100th time) they try to explain that the number they have is wrong). Does anyone have any ideas what I can do to help them. They can't afford to change their number, especially now.

    There are some letters with regards harrassment on here. This is one you could use and reword it as required. You could tailor it for your parents but the gist would be the same.

    Hope that helps, others may have some other advice.

    Harassment by telephone

    I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

    I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)

    I now require all further correspondence from your company to be made in writing only.

    I am of the view that your continued harassment of me by telephone puts you in breach of The Consumer Protection from Unfair Trading Regulations 2008, and the Protection from Harassment Act 1997.

    If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

    Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.

    Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)
