Hi,
my wife and i are selling our home and recently found out that survey has been carried out on our home without our permission.
The estate agents gave the surveyor our keys and didnt ask our permission.
As you can imagine we are horrified and furious.
We dont know what we can do, now. We dont want to lose our buyers, the estate agent knows this but we cant let them get away with this.We have no time to get to a Citizen Advice [plus they are alwayed jam packed].
I want to shout and scream at the estate agents but what will that achieve.
Can you imagine if my wife had been home ill in bed or something? Nevermind what maybe missing or whether we had bank details out or internet banking details lying around.

The EAs are acting on your behalf. Ask them to explain themselves. Are they NAEA members?
Mention this and see what they say;
http://www.naea.co.uk/uploads/COP/OEACodeSales%20Part%201.pdf
" 5f If access to a property is required by a person on behalf of the buyer (eg a surveyor, builder, tradesman etc) – and you hold the key but are not able to accompany that person – this must be made clear to the seller beforehand and his express permission obtained before you hand over the key."

Not a lot you can do TBH, maybe argue with the EA to get your fees reduced? Why does the EA have keys?0

EA told us it would be easier to show people round when we couldnt.
Cannon, i'll have a look-see0 -

So now you know you are dealing with an untrustworthy EA who doesn't stick to either common manners or codes of behaviour.
Would you really trust them, given what you now know, to
a) Get the best deal for you??
b) Stick to the rules from now on??
I'd fire 'em & find another agent. Now is the time for you to chose between cash-in-the-claw or your principles...
And the EA can pay for the survey: You hadn't agreed to it had you??

Cheers!

TBH, I would be more happy for a professional surveyor to let himself in with a key than the estate agent's 16 year old work experience employee. If you give the EA the key you risk them doing this. Why didn't you take the key back as soon as you found a buyer?I'm a Forum Ambassador on the housing, mortgages, student & coronavirus Boards, money saving boards. Buyers pay for surveys not sellers.
Not much point sacking the agent once they've found the buyer, xommission would still be payable.I'm a Forum Ambassador on the housing, mortgages, student & coronavirus Boards, money saving boards.
