Pressurised into exchange

Because the vendor has a chain and needs to buy a property, I am being pressured into exchange. Problem is, my solicitor hasn't even finished the searches and there are some open enquiries.

I want this property, but not confident until everything has been answered. What is most annoying is that it feels like my own solicitors are also pressurising me, almost as if they aren't acting for me.

What to do?

    tell them to swivel and to work for YOU and you alone. you are paying them remember!

  • It is completely up to you when and if you exchange!!! I am very suprised your solicitor is pressing you if not all in place it is usually the other way around.

    I would just call the solicitor and explain you feel there are some unresolved queries that you need answering before you can exchange ( i would also speak to the sales progressor about your queries and ask them to speak to the vendor to push their solicitor to give information) in terms of searches explain you are not willing to exchange till they are back and you have seen them and that the quicker they get these done the quicker you can exchange

    Are you both using the same solicitor? Sounds strange, I wouldn't like this and would probably fight back out of sheer bloody mindedness!

    Ask the solicitor to draw up an agreement making them personaly liable for any problems found after exchange, for a period of 1 year, that may have been found by actually doing their job. Stipulate 5x cost for all work required, minimum. See how confident they are, as it sounds like they want paying for not doing the proper work!

    Who is holding up the open enquiries? If it's the other side tell them to lean on their solicitors. If it's your solicitor dragging his feet, pressurise him.

    Under no circumstances should you exchange until all queries have been dealt with completely and to your satisfaction. If your solicitor is suggesting you should, then I suggest you sack him and make an official complaint about his behaviour.
