Am I entitled to a refund?

Hi all - I am after some advice.

I recently booked a weekend sailing course prior to going on a weeks sailing holiday (which I am already back from). However the course was cancelled due to bad weather and the company are offering an alternate date for the course or a voucher to the value of the course (almost £400).

I would obviously prefer the money back as the point of the course was to get some experience before the holiday, which has now past, so I am not keen on doing another course. The course was due to start on a friday at 6pm but we received the phonecall at 1pm on the Friday to say it was cancelled.

Their T & Cs do state that they can cancel the course for weather reasons and that courses are non-refundable, however, if I wanted to cancel I would have to give them 90 days notice. Can this be right?

Losing £400 is a bitter pill to swallow and I just wondered if there was any way around this.

    It depends whether that is classed as unfair contract terms,which seems possible.Have you got a link to the t & cs? The course should be rebookable at a mutually agreed time,and you don't have one,it seems.

    The OP isn't objecting to the cancellation,just the refusal to refund.

    You are correct hollydays. I'm not objecting to the cancellation - of course I understand they had to cancel and that obviously safety comes first.

    Mysolicitorisbetter - surely it does not matter that I did not leave enough time between the course and the holiday - they cancelled the course, and the alternative arrangements do not suit me.

    Surely a partial refund is not too much to ask.
  • It all depends on their T&C's that were agreed to. if for example it said should bad weather occur you will be offered another date and no refunds will be given and you agreed to it then its unlucky,

    If it mentions nothing about refunded you in the T&C's then I would like to assume you would have a chance if a small one at best of getting a partial refund
