sent someone elces personal financial info in my mortgage pack

:mad: we recently re-mortgaged with woolwich thru barclays, last 3 years they have been great. this time around they were atrocious. they messed up the rate, they messed up details like my date of birth, and they sent me a full key facts illustration for a total stranger. i know this guys full names ( and his girlfriend, they sound like a lovely couple) dates of birth, mortgage rates ( better than the deal i got i hasten to add) replayments, interest and all kinds of other personal data.
of course i was straight on the bank with two questions..

1, why did you send me this guys info, surely that is illegal?
2, where the hell did you send my details to?

eventually they did send my details to me ( again with a mistake, but as we have our loan with them as well they are our only choice for a mortgage as otherwise our LTV was too high) essentially this was just supposed to be a rate switch but they have got it completely messed up.
anyway we complained in writing, returning the originals of the other guys info ( kept copies for future ref) and they have today replied saying...

we made a very serious error ( not actually just the one but go on, ) and we are sorry, we will consider this matter closed unless we hear from you in 8 weeks!

so they admit they made a serious and im pretty sure, illegal breach of the data protection act and they havent told us is they have reported it, if they have told the guy who's details i have, how they intend to find my details which are still floating about somewhere or to offer us any compesation or recompense for this nightmare!

my questions ( and thanks for staying with me up to this point) is, we hate them now and dont trust them as far as we can throw them but we have a 3 year tie in so as we are only about 3 months in have to stay with them for two and a half years, can we get out of it? do you think there is any chance that their total !!!! up could work in our favour if we ask to be released from the tie in fee? i dont want to threaten them with the papers, as im sure the press would have a field day on this, but want to walk away and either sell up totally or find a company that will remortgage us.

are we stuck with them for the duration? and is this as bad as i think it is, i mean im pretty annoyed, i know they sent my details to someone but they dont seem to care to find out who. i know they sent me this guys info, he would probably be as upset as i am. am i being overdramatic here or are they truly as incompetant as i think they are?

  • They made a mistake and have admitted it. I can see how it's frustrating but what do you actually want? Financial recompense?

    Presumably, as you're in the mortgage now you won't have to deal with them for at least another 3 years so you shouldn't face any more hassle.

    Might be worth expressing your dissatisfaction to a higher level before they
    "consider this matter closed " .

    people in organisations do make mistakes... you have often read about it in the newspapers; databases lost, laptops left in taxis, documents put in the incorrect envelopes

    if there is evidence of systematic errors then complain to the FSA as maybe they aren't fit for purpose (but then the FSA aren't either).

    You seem to have suffered no financial lose so I doubt you will get any compensation but you can try.
  • It's not illegal to make a mistake!!!

    At the moment organisations that handle PII are moving towards becoming ISO27001 compliant. Even this accepts that !!!! ups happen!
  • our option tho is to get out of this mortgage and sell up to move, when we took out the mortgage we wanted to stay here and it was no problem to be locked in for 3 years but now we are in a position to be better off if we sell up and move. this is not our primary reason for complaining however ( dont want you to think im trying to get out of a tie in just because we want to move) we feel they made too many mistakes for it to be just reasonable human error, this is total incompetance.
    the underlying problem tho is that they made mistake after mistake after mistake. its not just sending one bit of paper to the wrong address, they sent his to me, mine to someone else, and when they did finally send me my documents they had my date of birth wrong -( i have been a customer of theirs for years) they had my husbands name wrong, and they had the total value of the mortgage we were seeking wrong. they fixed all of hat but have taken 8 weeks to tell us we are in fact right, they did !!!! up but they wont do anything about it. i understand we have not suffered a financial loss, and am not after cash compo, what we want is to be able to walk away from them as we have totally lost faith in them.

  • Although you open that response by saying your aren't trying to get out of the tie in because you want to move, what you go on to say sounds exactly that.

    You had a bad service but I don't think loss of faith in a company is grounds for cancelling your agreement.

    Probably not what you wanted to hear. Sorry.

    Presumably, as you're in the mortgage now you won't have to deal with them for at least another 3 years so you shouldn't face any more hassle.

    They want to get out of the deal without paying an ERC, which wouldn't be covered by a measly cheque of £50.

    Mistakes happen.
    You had 8 weeks to complain when the incident occurred, but didn't take up the offer within that time limit.

    If you want to pull out of the deal you signed up to 3 months ago, you will have to accept the penalty fees and pay them.

    i complained in writing the first day. they responded in 3 weeks saying they would respond in 8 weeks, they have taken 8 weeks to reply which i received today, i am wondering how to proceed from here.
    im not happy dropping my complaint as they admitted they made a total mess of it and seem to think that is fine. if we still beleived in them then we would be happy to stay with them but if this is how they plan on dealing with our financial details then im wary of staying with them any longer than we have to, if we have to then we may well pay the tie in fees to get away from them. i was wondering if they have broken any laws by messing about with my details like this.
