Hi all, hoping someone can help me.
I used to live with a friend a couple of years ago, but we moved to our own houses about 5-6 years ago.
Last month she recieved 2 debt letters adressed to me at her adress- i have never lived there. She passed them over to me, and they are from Lowell regarding 2 3G mobile accounts.
I have rang them up- stupid, i know but my friends husband would not be happy if he knew they recieved letters like this to there house!One of these debts is for £60.03, it is a mobile number i did used to have, it is possible that a payment got missed when two contracts crossed over, I have written to them and requested a f&f of £30, am awaiting a reply, thats all fine and dandy.
The other debt is for £256.56, and is assigned to a mobile number i do not recognise. I told them that on the phone, and told them i would be speaking to 3 as i do not recognise this as my debt- any debt that i have known about i have cleared!
But since then I have read on here that the onus is on them to prove the debt, not the other way around, so i have just written them a letter requesting evidence that it is my debt, as i don't believe it is after reading some stories on here! The problem is, since then I have recieved a letter from red collections threatening to send bailiffs around, and this morning i have a card from the postie, adressed from lowell, stating that they are trying to contact me, and are going to try again.
This is making me very nervous, as they do not have my telephone number, so I can only imagine that this means they are sending someone round! Is there anything i can do?what rights do i have/ they have regarding bailiffs coming round, been as I have only posted my letter today, so they wont have recieved it yet, and that they could dispute they ever recieve it as it is a PO Box it is going to so i cant send it recorded delivery?
Any help would be appreciated,

Firstly, it won't be bailiffs as they can only come if you've defaulted on a court order. They MAY send a doorstop collector who has no legal rights whatsover and if someone does turn up, tell them to bog off or you'll call the police for trespass. You don't even have to speak with them.
For the small amount that they are claiming, I doubt they will send anyone as it will probably cost them a lot more to do it and there is no guarantee they will get any money.
They are full of hot air and I'd not worry about getting a visit too much.Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free

Nope. They have no rights whatsoever and cannot touch any of your stuff. They have about as many legal rights as the paper boy.
DCA's are full of hot air and will threaten bailiffs etc. Bailiffs are court appointed representatives so unless you have been to court and defaulted on a court arrangement then they can do nowt!
If any one should turn up just tell them to sling their hook. If the debt is in dispute then they shouldn't send anyone anyway so complain to the world!
They are just trying to frighten you into ringing them. Do as you are and keep everything in writing.Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free
