Advice needed again

I posted a few days ago about two phones I bought and had not recieved and it resulted in me starting a chargeback on Sunday. Then out of the blue, with no communication from the seller the two motorola L6 phones turned up today.
When I recieved them the first thing I noticed was that the boxes where not in mint condition, which I would expect for new phones and one of the boxes was acutally torn. Next, when I opened the boxes the phones had had all the plastic coverings removed and only one of the phones had the hands free kit with it. The phones themselves look brand new but it is very hard to tell.
Also I paid for parcelforce 24 delivery and the phones were only sent by normal first class post.
What do you think I should do. Given the lack of communication with the seller before, do you think there is much point in emailing them?

    I would email them yes, seems like very poor service and make sure you make you warn others when you follow up with feedback, if your not 100% happy with your phones I would send them straight back recorded delivery, whilst doing a charge back through paypal.

    But does he have to refund me, if I just say I am unhappy with the service and the condition of the phones. I do think the actual phones are brand new but the boxes just don't look very good. I don't really want to send them back as I am worried that I won't get my money back.

    If I was you, if the goods are not as described, returrn the phones asking for a full refund whilst in a charge back with paypal. its is the sellers responsibility to make sure the goods reach you and are as described, if not then you have more than enough reason to warrant a refund through both ebay and paypal.

  • Start the chargeback with Paypal, don't send them back until Paypal tell you to & make sure you are covered with insurance (if they were more than £32 then you'll need to use Special Delivery). Paypal don't always pay out if it's not as described but will tell you if they are going to when they request you send them back - even then if seller has no money in Paypal then you'll get nothing back.
