Salary Overpayment

I changed jobs back on 2nd december 2008 and was subsequently paid for all of December. As I was due 1 days pay and some holiday I asked the company in january to confirm the amount to repay. I subsequently received no letter but a payslip and P45 including the overpayment.
When I gave this to me new employer they then paid over more income tax and NI in the year.
In April I got my P60 and reported this to HMRC and my benefits were reduced. I have now received a letter this week threatening me with debt collectors and also saying this will effect my credit rating.
As this was 6 months ago I have spent what was left of the money after the addtional tax/NI.
Does anybody know where i stand ?

You must prepare to pay it back. You should have written in Jan and kept a copy - did you do this or did you just phone or whatever?
Ask for a breakdown and an explanation from them of how they intend to address tax etc. While you ask reasonable questions and they don't provide an answer they are in a weak position to take it to court or even put debt collectors on you. Plus it cannot affect your credit rating unless they get a court judgement and you fail to pay. They are very wrong to start suggesting this at the first communication.
