Blair Oliver Scott & CCA

Hi there

My DH is contemplating sending BOS a CCA request.. but I thoght I would check on here to see what the chances were of them having it. His original loan was with the AA.

I am wondering, as they are an in-house DCA, are they more likely than most to have copies of CCA's?

  • I have Blair Oliver and Scott on my case regarding a loan i had with Sainsburys bank. I have asked Sainsburys bank multiple times from the CCA but they never once did send it to me. ( making me think they do not have it )

    Im going to give BOS a call this evening and see if they have access to it, if they dont i will once again call Sainsbury's for it.

    If they do not have it i will call BOS and ask them how they are going to enforce the debt.

    Does any body know where i can get a template letter asking for a copy of the CCA.

    Yes, you can get a copy of it via the national debt helpline. Let me know how you get on with it as we are sending ours to BOS this week. DH's original debt for AA goes back to 2002 but cannot remember when BOS took over the debt. I will let you know how I get on.

    http://forums.moneysavingexpert.com/showthread.html?t=767025&page=189 - Gargrave had a 'mocked up, fraudulent CCA sent out to her so if they do send anything to your OH make sure you check what you have received)

    Guilford girl - you should always send a CCA request to whoever is chasing you for money at the moment, they should comply with your request directly. If they try to tell you to contact the original creditor they are in the wrong and so you can still go ahead with the 12+2day letter etc

    Blair, Oliver and Scott are the 'in-house' debt collectors for Bank Of Scotland (now Halifax Bank Of Scotland). I would not be surprised if they don't add a fourth partner, such as 'Higginbottom' to suit their current status. :rolleyes:
    They are, in effect, little more than a 'software' add on, so that anyone within HBOS Collections can print off a letter with Blair Oliver and Scott heading on the paper.
    As BOS administer loans for the AA, as well as the Banking Service for Sainsbury's, many posters who, otherwise, have no accounts with HBOS, will receive letters from 'Blair Oliver and Scott'

    No matter, they are still legally obliged to provide you with a true and compliant copy of the original executed cca, plus details of the account, within 12 working days of your request, and £1 Statutory Fee.

    If you have, already, requested your cca from Sainsbury's Bank, then you do not need to request it from BOS.

    Even though they are 'in house' they are trying to make it appear that they are, in fact, a completely separate organisation. Whilst this is contrary to the OFT Guidelines on Debt Collection, as it is deliberately 'contrived' to cause the debtor confusion as to who he/she is actually dealing with, I would be inclined to 'play along' with their act.

    Sainsbury's are 'in default' by not having provided you with a true and compliant copy of the original executed consumer credit agreement' and will remain 'in default' until such time as they do provide the cca.
    Whilst they remain 'in default' the Act does not permit them to add interest or charges to the account - nor does it permit them to pass the debt on to a third party for 'collection'.

    So - treat it as though you don't know that BOS are part of HBOS and send BOS a copy of the 'FORMAL NOTICE - ACCOUNT IN DISPUTE' letter that you will find on post 7 of http://forums.moneysavingexpert.com/showthread.html?t=963087

    hi, I too am with blair oliver scott...they have sent me my sainsburys credit card application form but it is little more than that. I have put the 'account in dispute' and stopped paying them. So far I have received a couple of texts from them asking me to call them.
