Just wait for 6 years?

Someone I know has lots of debts racked up while in a previous relationship. At the time the debts all came out, parents paid some but nothing has been paid since. All phone calls and letters come to parents, so the person never reads them or answers the phone.

It appears they are just waiting for them to go away! Is this possible, after 6 years will they all be unenforceable and they will have got away with it?

It seems very unfair for those of us who are struggling to pay off debts

  • A girl a used to work with is doing this, she got married and moved away to a rented flat in the husband's name. Has been ignoring her debts for 4 years now, she thinks after 6 they will go away.

Its very unfair, but then again she would never be able to get credit again and her chances of getting a mortgage would be very slim.

They might go away, but if there's a CCJ or decree issued, the debt will never become statute barred. It all depends on the action taken by the creditor.

  • thanks for the replies,

so its fair to say that she will probaby never pay them back. It is just so disheartening to hear all her talk of meals out, dresses and expensive things!

Tell her that you don't want to hear about it!
Is she the kind of friend that you want in your life?
What else is she dishonest about?

It's easy to give in to that negative voice that chants "cant do it" BUT we lift each other up.
We dont count all the runners ahead of us & feel intimidated.
Instead we look back proudly at our journey, our personal struggle & determination & remember that there are those that never even attempt to reach the starting line.
  • Tell her to grow up and think of her poor parents. DCA will fight hard to get the money back.

I thought it dropped off your file after 6 years? You could then start rebuilding your credit rating, or am I misinformed?

  • Thats what i was wondering robinson-in 6 years is this all just forgotten about and she will be fine to get credit again?

bank of slate- no she is not the kind of person i want in my life, but she is related to OH. drives me mad to be fair, the debts are kept hush hush which to me feels like she is getting no 'punishment' if you get me!

thing is she is such a snob, loves expensive things!

oh well, best to plod on in the rat race to pay off the debts!
  • You could be evil and send the companies her new address.

    Not too sure about this.

If the account is closed, then the debt would fall off after 6 years, but if they haven't closed the file - it could well stay on.

Its only 6years after the last repayment that the debt can be classed as statue barred so if her parents have paid some on her behalf that could affect the date.

Everything entered stays on for 6years - so if a company defaults her after 12 months of non payments she would still have another 6years before it can be removed. As George says they will try to get CCJ and if they do the debts do not encessaily disappear.
