Holiday pay.

hiya, now today i got sacked from my job and is trying to work out what holiday pay i should be paid.
1/ the holiday period started on 1/04/09
2/ i used to get 28 days holiday.
3/ i took 10 days off holiday.
4/ my after tax was £217.00 take home.
5/ i left on 10/august 2009.
i also had 25 days frozen holidays left.ie because i had been their so long i built up holiday which i couldnt use but got when i left.
does anybody know must i should be looking at getting.

If you'd left at the end of July, your holiday entitlement for this year would have been 1/3 of 28 days, which is 9.333333333333
But as you've worked just over a week of August that rounds it up slightly.
So I'd say you were entitled to your 'frozen' holiday pay, plus maybe a titchy bit of annual leave.Signature removed for peace of mind0 -

If they work your salary for August out as 10/31sts, then yes, 35 days salary would be about right.
However, they might say you've worked for a week in August and divide your annual salary by 52 and use that.Signature removed for peace of mind0 -

I thought you said you took 10 days holidays this year? So if your this year's entitlement is 10 days and then you took 10 days out then there is nothing left for this year.
So only those 25 frozen days should be paid (if they say they will pay them in your contract).0 -
your holiday will be split up pro rata, i.e. I get 24 days per yr (+BHs) and my holiday year starts 1st Jan. If I leave at the end of August, I will be owed 8/12ths of my holiday as pay (i.e. 16 days) MINUS any I've taken. I've taken 4 days holiday so far so could be paid for 12 days.
If I''ve gone over, i.e. I took a 3 week holiday in January, and 1 in April (i.e. 20 days) I will owe the company money for 4 days pay, and this would be deducted from my final paycheque.
I assume your company works in a similar way. If you have accrued 25 days holiday from previous years (wow, not many places do this!) then if it's their policy, then you will receive this as a cash payment on top.
