Unfortunately my memory is really bad! The old tax disc expired at end of June and has sat in the door pocket of my car since then. I only realised I'd not displayed it on 4th Aug when I got the ticket issued by police while I was parked in the Asda car park. I guess I need to just pay up and give myself a good lecture!!
    Thanks for your responses

Ok, so the 5 day grace period won't apply, but why did the police ticket you on private land? You only commit the offence if you failed to display on a road. Did they witness you driving on the road before entering the carpark?

You may want to question this before you just pay up. If they say they did witness you on the road, then it's a fair cop.

I don't think they can ticket you on private land - you were not committing an offence at the time.

You might even be able to try blagging it and saying that the holder had fallen of your screen in the heat, and you stuck it back on immediately before leaving the car park...

(It's not as if you had avoided paying, so it's more of a white lie IMHO.)

Unless of course the police took a photo of the out of date tax disc on display in the car at the time they booked it (like they sometimes do on tv police shows). Then that would clearly show the holder in place with the old disc there and prove they attempting fraud maybe

Well, it might've been in a separate holder that miraculously fell off... It's not an offence to display an old disk too, is it?

Anyway, ticketing on private land is the nub of the question; perhaps thanking them for the reminder before going out onto the Queen's highway would be in order too.
  • the offence and ticket and penalty are from the police for FAILING TO DISPLAY, sorry but the fact you had one cuts no ice with the police... pay it.

the ticket then goes to the DVLA who will imput the ticket. then action it. if you had a valid tax disc on that date of offence, they close it. no ifs no buts.

your out £60 but it wont get worse than that.
