Constant Pay Disputes with Employer

i have basically built a spreadsheet that works out tax and NI for the hours that i have worked over the pay period.

in the last 2 months which has had 4 paydays (paid fortnightly) i have been underpaid by about £60 and paid late on 1 occasion and also been underpaid every other payday too.

I am looking at this up coming payday and thinkin that i'll be underpaid again which would equate to bein underpaid £100 or more in a month.

I kno to most this seems trivial but when i'm on £5 an hour and working consistantly 120 hours a fortnight its the difference between being paid £500 a fortnight or £400 odd.

I'm 19 so £5 an hour is above NMW for my age range (18-21 = £4.77ph)

many thanks

How are the underpayments occurring - tax? NIC? Is the total gross, before any deductions, correct?

I think you need to actually sit down and point all this out to them. Have you mentioned it to them? Are all your hours logged on a timesheet/rota? Bring in your payslips and point out the difference in hours paid and hours worked. I think I'm right in saying that companies have to keep timesheets/rotas for at least 2 years for records, so they should have them. Is anyone else in your work getting underpaid?

Also working 120 hours in a fortnight? Thats 60 hours a week! I'm sure its law that the maximum you can work in a week is 40 unless you sign a waver saying its alright for the company to put you down for more.

It doesn't seem trivial at all to me. I remember when my pay didn't go up when I turned 18 I kicked up a stink over £20. I don't know if you're a student etc but I know that when you're trying to make ends meet every penny can count!

So, tell us how they are underpaying you. Where is the difference between your pay and the spreadsheet? Number of hours? Tax? NI? Other deductions? Hourly rate?

Without knowing how the problem arises it is difficult to advise.

lol dont work for burger king or the like do you? i used to have problems like that when i left school, they always managed to explain it away as "labour saving breaks" surely they have to tell you if theyre taking you off shift... and surely you should stop working.. but no, anyway thats a different story :) hope you get it all sorted

    its the hours worked

like last fortnight i was missing 17 hours off my payslip which would equate to about £85 before tax and NI and £60 after

i have made a spreadsheet manually using the data from direct.gov to work out what i should be paying tax and NI and this has come out correct according to my hours that they have paid me for

I think it is just the hours difference from what i've calculated which wouldnt surprise me tbh.

Have you remembered to take off for breaks (Although highly doubt that would add up to 17 hours)
Speak to your manager or other superior about it

Your pay slip should have hours and rates gross pay, NI ,tax correct

If the hours/pay are wrong get that fixed first.

Tax and NI you can fix on your tax return.
