disabled car tax

I hope sombody can help me with this. My mum sadly passed away in October, so i took over the lease on her car. The car had tax until July 09. I have just received my car tax renewal and the class is stated as disabled, which i am not.
I checked my log book which i had sent to me in December and that has disabled on it as well, i didnt check it properly when it was sent to me, which is my fault. i wasnt aware that my mum had free disabled tax.
Not really sure what to do now. Im guessing i will need to go to my local DVLA office to notify them so i can buy some tax for the next 6 months. Does anyone know if the DVLA will make me pay for the back dated tax from December when i took ownership of the car?
Should the DVLA have changed the class of the car from disabled to private when i notified them that the car had changed hands.

    Condolences on your loss. You will need to take it into the local DVLA office and advise that the car is no longer classed for disabled use, you wont be able to tax it at the post office etc until the change is made. If they ask questions explain the circumstances and that it had tax on it until July and you didn't realise it was on a disabled tax disc. Not sure if they will back date the tax or not.

    The DVLA would not of changed the class of car when you notified them as its the new owners duty to declare any changes even though it would make sense for them to check that part.

    Be careful what you tell them, because technically you have been driving the car illegally since your Mother sadly passed away.

    Sorry for your loss.

    You'd be best not telling them anything. Just take the registration documents to your nearest DVLA centre and tell them you want to re-register the vehicle as from today. They will sort out the paperwork and you can pay for your road tax and get the new tax disc at the same time

    Unfortunately it appears that the OP did change ownership details at or near the time of his/her Mothers death.

    Not on motability lease is it? If so I think it's a whole load more complicated as there is no mechanism for taxing a motability car other than disabled class if previous threads are correct:confused:

    If it is an motability lease, it is a lot more complicated because it is conditional upon having high rate mobility DLA, and of course that would be surrendered on death. But as far as I know, the car would be registered to motability, they keep the registration documents and they arrange for the new tax disc to be sent out, so this is unlikely (I hope)

    Sorry, yes I realise that. It is the registration status that needs changing, not the ownership details. This can happen independently of change of ownership - if the owner no longer receives HRM DLA for example. Also if the car is going to be used by other members of the family as well as the disabled owner the status should be changed to pay tax (although that isn't always known).

    It is strange though that OP has the reg docs for a leased car - I wonder if she meant Hire purchase?
