Protected goods
I write to inform you of illegal practices by a trader against myself.
Following removal of my car 08 July 2009 of which the total purchase price including interest was £10,061.20 & according to their solicitors Bermans letter to me dated 12 June 2009 the outstanding balance of £6,061.94 it therefore follows that more than one third of the total price had been paid. In these circumstances the goods have become protected & cannot therefore be removed without my consent.
On the 08 July 2009 the aforementioned vehicle was removed without consent & in the process the agent assumedly acting for MFL entered my property to remove the vehicle without a court order.
I refered them to the financial agreement number dated 13 March 2007, the section under ‘KEY INFORMATION (cont), subsection ‘REPOSSESSION: YOUR RIGHTS’.
As I had paid more than one third of the total price these goods were protected therefore Marsh Finance Limited were in breach of the Consumer Credit Act 1974. I therefore want to exercise my right to recover from the creditor (Marsh Finance Limited Consumer Credit Licence 359991) all sums paid by the debtor (Me) under the agreement namely the sum of £3,999.26.
Please can you advise me of the next course of action to take.
