Sent the wrong sunglasses

Hi all,
Last week (Wed evening) I bought a pair of sunglasses on a BIN and paid immediately. The sunglasses arrived on Friday signed for but I was away for the weekend and only opened then on Sunday morning.
They are not the colour I ordered and tbh I don't want these ones. Also it is clear they are the wrong ones as it says the other colour on the package! And also they are a replacement pair for some that I broke!
So I sent the seller a message on ebay asking them to swap them on Sunday lunchtime, then sent another this afternoon as they have not got bck to me.
What happens now? If they don't respond, do I open a dispute because technically the item is not as described? And how soon do I open a dispute? But I really do want the other ones and they are a good price!
Anyway, any help much appreciated, never had any probs before!!

Yes, open an item not as described dispute through Paypal. Maybe they haven't logged on yet and seen the message, so I would leave it maybe until tomorrow to give them a chance to reply.:j30/7/10:j

Can I insist on them paying the postage for me sending the other ones back? Don't see why I should be out of pocket for their mistake!0 -
Ebay do not make the seller pay return postage, it seems unfair but so is life:(
Many sellers choose to pay return postage, they are the good ones (there are quite a few I have found) as far as I know, there is no way you can "force" them to pay return postage.
If you end up returning them, make certain you do so by a trackable method as you may have to prove they have been returned to win a dispute.

So would recorded delivery with insurance be ok then? They are worth £95

Although Recorded delivery is okay in theory, Soolin (the board guide for this section) has repeatedly said she has had numerous recorded delivery packages where the postman didn't bother to get a signature.
This hasn't happened to me, so I am only repeating what I have read on this section a lot of times, also recorded is not fully tracked, unlike SD.
A standard special delivery would include all the insurance cover you need I believe and is fully tracked, with £95 at stake I would certainly consider SD a worthwhile expense in your position.
This is just my opinion, and someone else with more experience may be able to add to it.
I will just wish you luck and hope you manage to get things sorted to everyones satisfaction.0 -
