I would say yes it would be fair to say that he cannot be your witness as the disciplinary is linked.

My freind and myself have been told we have been dismissed from work under the suspicion of drinking or being under the influence, we both got sperate leeters issued to us individually which pretty much accuses us both of the same thingt, now the disciplinary hearing is set for the next few days, they say i cannt have him as a witness as the issue is linked? Is this the case?
Let me get this straight......you want the person who is co-accused with you to act as your witness?!? Oh my lord......
