problems with orange advice needed please

i recently upgraded in april they sent me a nokia n85, since then the phone has had the same fault 3 times each time they have sent me a replacement phone the same fault has occurred, i called orange and they under advice of nokia stopped sending the phone out to customers, Orange are prepared to replace it with the N95 which is 2 years old and in my eyes is not a upgrade , am i in my rights to cancel the contract?.


Any advice would be great
