Advice needed please

Hi guys, after some advice...
I brought some Diesel jeans off an ebay seller which were listed as 'BNWOT' and stated in the description they were 'brand new'. When I received the jeans, they had clearly been shortened (and not very well).
I emailed the seller and expalined that I was not happy and her response was that she had listed the length as 25" so it's not her problem. She stated that they were unworn and brand new therefore the listing was not misleading. My daughter already has several pairs of these jeans in this particular style so I knew age 12 would be a perfect fit and therefore paid little attention to the leg measurements. Maybe I'm being naive but I assumed that something listed as BNWOT would be in the same condition as it was sold in the shop only minus the labels.
Do you think it's any use going through the paypal dispute process or will it be a total waste of time?

Take them to court. This can be done via specific websites for 99p. You will only have to pay that. You are looking at £2 - 500 payout.
Alternatively, grow up, use Paypal and stop crying into your cut offs!!0 -

Give it a go.
According to ebay, new means:- It's in the original condition from the manufacturer, distributor, or retailer.
- It has not been refurbished or used for any purpose.
- It has no known defects or damages
However, it also states:
Handmade or custom-made items that have never been used for any purpose can also be considered 'new'.
But if they were custom made, then they are not Diesel.
The other issue you have is that the length was stated. It would possibly depend on how well this stated. e.g. if it siad in the description that the length has been shortened then you would probably lose, but if it was just given in the item specification, you have a good chance of winning.

Thanks for your responses.
The listing didn't mention that the jeans had been shortened although the waist and length was stated. I really just wanted some confirmation that I wasn't being unreasonable in expecting them to be in unaltered condition as they were being sold as BNWOT.

You are pretty much certain to win the dispute for SNAD, but you will have to return the jeans by trackable means at your own cost.0
