I am looking to take action against the people who I bought my house of off as they did not disclose the problems thay had with their neighbour who has an ASBO ! and now I am having the exact same problems.
Before I make a claim I need to know how much to claim so I need a valuation expert in the south east area who can say how much the cost of my property is reduced by due to the fact that I live next to someone with an ASBO ?
Help me please !

If you go to the RICS website, you will be able to find a valuer in your area. They should be able to help you. I would imagine that you would be able to claim back the cost of this when you sue the people who failed to declare this when they sold it to you, but i'm not 100% sure of that.0

Hi and Welcome
Sorry to hear you are having these problems. Just out of interest how do you know the people you brought of had problems with the neighbour?
Did you contact the LA before purchase to check for complaints?0 -
Can you not help your new neighbour through their problems and work with them for salvation?? It is, surely, the British way to try & understand others and help them??
Yours in hope...

I have been told by the police that numerous complaints were made and have a letter from a court stating that they gave evidence for the prosicution when he was served his ASBO. Who are the LA ?0
-
That depends where you live! Seriously though, its the Local Authority.0

LA = Local authority. You can place a FOI request with them which we do for free or some LA may charge a small admin fee (£15 ish) and will give information on noise complaints and othe issues where they have been asked to be involved. If an ASBO has been inforced usually at some point the LA would of been involved usually through Environmental health dept.
This then could be used as evidence if needed or on the other hand could show they never complained.
Have you got what the police are saying in writing?0 -
Did you specifically ask the question, "have you had any disoputes with your neighbours", and did they give an answer in writing?Debt free 4th April 2007.
New house. Bigger mortgage. MFWB after I have my buffer cash in place.0 -
I wish i'd known about the LA before I moved - I phoned the local police and told them the address i was moving to and said have there been any incidents that would put me off living there and they said that there have only been some minor disturbances nothing out of the norm and it was a safe place to live. They did not tell me that I was moving nest door to someone who has been served an ASBO for neighbour harassment
They cannot put anything in writing to me until I issue a claim notice to the sellers then I need to get a court order to see the list of complaints that were made from my address.
Before I issue a claims notice I need to know how much to claim.0 -
They have to fill out a form called the SPIF and on there they stated that they have nover complained about their neighbour0
