opinions please tenants and LL!! getting deposit back

we have been in a rental house for over 18months, our relationship with the LL has to be fair been up and down.... jobs we have asked to be done, not done, chasing things up was a common situation. we gave our notice and agreed a mutual handover date, where we would both inspect the property together.

we moved out of the property the weeknd before handover, spent the week cleaning etc, we returned to the property at the agreed time to find the landlord already in the property!

things then went from bad to worse, he was unhappy over various issues, all of which we dispute, 1) claims we painted one room - we havnt, he said the standard of painting is not what he would have done?!?!? its shady in places, but to be honest its always been that way??? and with furniture in the room have never noticed until he pointed it out , the inventry simple states cream walls, which they are?!!

2) the conifers not being kept tidy?? - they were trimmed and maintained, even tho the contract says we dont have to maintain trees! but he argues there bushes????

3) the shower door off the rail, have no idea to be honest, it was certainly on the rails when we left....

he was coming up with all sorts, but when push came to shove he only documented these issues when we insisted on him writing them down and signing.

where do we stand in all this, we have pics when we left the property and the garden is tidier than when we moved in, the house is spotless, we took pics when it was all cleaned and tidy
as yet he hasnt wrote to us at all, does he have ten days or ten working days??? he did no final inspection report with us and had no documentation with regards to a final inspection, we insisted on him writing and signing the issues he had on our inventory which we took with us as we felt very vulnerable
can he add to these issues?
any advice would be really really appreciated, we are really worried about our deposit, its so upsetting as we feel we really cleaned and tidied more than most people would, even weed killering the drive! and taking the bin contents to the tip!

thanks:o

If you can't reach agreement, you can use the tenancy dispute service. It is set up to sort these sort of matters. I take it he protected the deposit in one of the schemes and gave you details?

Just wondering if you've pursued the repayment of the deposit through whatever deposit protection scheme your LL used? I only know some details about the scheme my former LL used (the DPS), but I know they offer some sort of alternative dispute resolution (ADR) service which needs to be pursued before the court will consider passing judgement in your favour. My delightful (note heavy use of sarcasm!) former LL repeatedly refused to return the deposit to me through the scheme, and repeatedly refused to use the ADR, which left me no choice but to go to court!

    Good luck!

ps. Your case seems a bit more complicated than mine. Just in case you haven't seen it yet, there's a monster thread by EagerLearner which someone pointed me in the direction of, and will give you an idea of how difficult it can be in getting money through the court system! http://forums.moneysavingexpert.com/showthread.html?t=227606&highlight=Pendulum
