our windows have been smashed and our landlord is in administration!

Hi,
5 of our windows were smashed last night and the people then ran away. We know why they did it, it was because of the end of season football results and a certain neighbour we have - they got the wrong house. We have had graffiti on our garage door a few weeks back but it washed off easily. We had the police round after it happened and we have an incident number (took them 1.5hours to get here, when will I start to see the fruits of my 40% tax).
I have contacted my insurance company who said this is a buildings insurance matter so I need to wait a few hours till the agent opens. I am worried though because I found out the property owner, a builder, has just gone into administration. Maybe I will have problems getting this fixed today/ever.
I am also worried we wont get our deposit back, we're in Scotland so the deposit is being held by the owner.
Our lease is up in 8 weeks so we'll just move out, this is not worth the hassle. The people who are the real targets are very apologetic, feel extremely guilty. I feel sorry for them a little, this violence is just senseless.

sounds like a great place to live... I cant really offer any advice I;m afraid, but you have my sympathy. I hope you manage to find somewhere nicer when you move and good luck getting your deposit0
-
i very rarely suggest this, but if your LL is in bankruptcy and cannot pay your deposit back - i would be tempted to not pay your last months rent0
-
no way we're paying any more rent until we know where we stand
The annoying thing is, this IS a nice place to live, or was.0 -
football fans... such nice people. NOT. You would never get this with Rugby fans.

Sorry to hear your story but at least @ 40% tax you are presumably getting a fair bit of income.
Was it Bears or Bhoys broke the windows and are you in/near Glesga???? (Whoever it was it is inexcusable).
If your LL is Bankrupt I'd strongly suggest not paying LL/Agent any more rent, although to show you weren't being entirely irresponsible I'd open a new bank account, name it e.g. "Rent Account" and pay the rent that is due in there. I'd write explaining you are doing this temporarily to the LL, copy the agent explaining this, asking who has the deposit & asking who the mortgage is with (mortgage company may decide it wants your money...) and send the letters recorded-signed-for so there is no dispute later that you weren't being open and honest.
You don't want a Sheriff Court action against you from the "Accountant in Bankruptcy"
http://www.aib.gov.uk/contact-us
(the legal figure who handles bankruptcies in bonnie Scotland).
I wonder if the Agent is negligent in not taking sufficient steps to ensure they were acting for a LL who could afford to rent out (or indeed is Registered to rent out
https://www.landlordregistrationscotland.gov.uk
(You can look up your property & see if he was registered)
or has permission from his lender).
Cheers!

theartfullodger; we're in East Kilbride and it was bears. EK is a very rangers town. This is what happens when they win?? Unfortunately we live next to a celtic players relations and through some sort of chinese whispers, they are targetting my house more than theirs.
I am making a decent income. Withholding the rent is a great idea, we are going to do this and let them know. Feel really lucky that our lease runs out in 8 weeks.
We've been in contact with the agent now. They are going to contact the owner and get back to us. It has been around 2 hours now, still waiting. We really need to get the windows boarded today before night sets in and/or the rain starts.0 -
I'd ring shelter.
You should have the windows measured for replacements and boarded as soon as possible. My worry would be if the owner is broke it won't happen. I'd get in touch again and ask what time it is being done.
Then take it from there.
I'd say it was time to move0 -
we bought some frosted adhesive rolls for putting over broken windows from b&q. With that on and blinds shut it will not be visible so that'll get us through tonight I think
Agent can't get hold of the owner, no suprise there........ But he did say he is trying to get someone to board it up today but it might not be until tomorrow. He is quite a decent chap really.
Will start house hunting tomorrow, sighhhhhh.0 -
t1gger - sorry to hear the news re. the bears..
Can't say I'm surprised (some will disagree...) re the allegiance , although most fitba fans are decent enough and some Rangers supporters OK.. There seems to be a evil faction particularly associated with them, and I'm pleased the club is doing more&more to get things under control.
I sincerely hope the Police have been informed, although round there they are often believed to be sympathetic, there must be some Lodgical reason...
Cheers & good luck ! Make sure if you withhold rent you do so making it clear you have the funds and are willing to pay when you understand LL's situation...

thanks! we will make it clear to the LL and agent. I think the builder has gone awol now, even their website has gone offline.
Police came on the night although because it took 1.5hours to get here they had no chance to have a look around for the boys. They were quite frank about it, they weren't even from EK, they had been drafted in last minute.
Won't be much sleeping in the household tonight!
Glazier comes tomorrow, onwards and upwards.0
