Endowment seller has no records!!

Endowment was set up through the estate agent whose name appears on the documentation I've got. They claim to have no records and say their reps. would not have miss sold. Any ideas where to go from here?

    Mine said the same, my reply was " if you dont keep the documentation then how would you expect me to keep all the notes from 15 years ago" I also told them that it was missold and if they couldnt provide the documentation to prove it wasnt then they didnt have a case. I got my compensation.

    When did you buy the policy and were the estate agaents truly independent at the time of the sale

    Going off the Q&A columns in the weekend papers, I thought that if the seller couldn't produce documentation to verify that a proper "attitude to risk" assessment was carried out, and it was established that you weren't highly risk averse, you have a prima facie case for mis-selling?

    Perhaps some of the experts on the board could comment.
    I really must stop loafing and get back to work...

    Yep.It's up to the seller to prove the case, so if they have no documents, you have a good chance of winning the case ( assuming you're not obviously trying it on, which is quite easy to spot).
    Trying to keep it simple...;)
