Lloyds loan account - SAR - NO paperwork

Have been paying a DCA for approx 3-4 years randomly for Lloyds TSB 'Debt'.

Then thought - hang on - they're after over £13k - my overdraft was only £500, credit card circa £2k and a loan i think for approx £3.5k...so how did that ever become £13k and why was i paying it???

Did CCA letter to DC agency. Who passed it to Lloyds. Who have now replied with the following text;

' Thankyou for your request under Section 77/79 of the Consumer Credit Act 1974.

I am unable to provide a copy of the original loan application documents due the the amount of time that has elapsed since inception of this account.
Whilst the bank is obliged to hold application documents for a reasonable period of time, i do not feel that it would be realistic for us to have retained these since your account was opened some 10 years ago'

What do i do now??:confused:
How do i get closure??:p

    Are you sure the debt you have been paying is yours?
    Have you tried reclaiming charges?

    You did not request a copy of the loan application documents. You requested a copy of the customer credit agreement. The credit agreement is a legal document and if they have not retained it, this is not your problem.

    I am however a little concerned at how they may have lumped the debt together as one. They may still say that you owe whatever the balance is on your overdraft as the payments were going towards another account like the loan.

    A few things you need to find out:

    What did the DCA request from the bank? If the DCA does not provide a properly executed CCA in the required time, send them the 12+2 day letter. They have a legal obligation to provide the document in the time allowed; failure to do so is their problem, not yours.

    What have you paid so far? Have the DCA provided a breakdown of costs and payments? Did they give you the account numbers and details that you have been making payments to? I would request a copy of all transactions and statements from them.
