Hi

I am getting married soon and will be moving in with my new wife who owns her own house with her sister. Her sister still lives with her parents and as no intention off living at this house, they are asking me to sign a pre nupt which I do not have a problem with, we have agreed in 5 years we will try and buy her sister out. In the future if we fall out with her sister where do we stand and also she wanted to charge me rent but after advice she says no and I have offered to pay her half of the mortgage but she as refused?

Can you advise please?

Have you had this "pre-nup" checked out by your own solicitor? I didn't think they were legal in this country.....

If she has taken advice & consequently won't take rent or allow you to pay the mortgage, then either look into saving the equivalent of half the mortgage or the possibility of overpaying on your new wife's half of the mortgage (but this may affect the sister's "half" too).

Is there no way you can buy her half now?

Cannot buy here out due to paying off depts.

Errata

Pre nuptial agreements carry no legal weight, although a divorce judge may take it into account.
Are they joint tenants or tenants in common - it makes a difference.

They are joint tennants but her sister lives with her parents
