Online purchase query - money taken over a month ago and product still not shipped

First off apologies if this is in the wrong place - seemed the most suitable place.

I ordered an MP3 player case from pixmania on the 9th Feb for £11. The item was described as being in stock, however since checking back the website appears to say that the product will be in stock the next day (i.e. when I checked on the 14th it said it would be in stock on the 15th, when I checked on the 26th it said it would be in stock on the 27th). Today the item states it will be coming into stock on the 9th March - today.

I received my CC statement today and the full payment was taken on the 10th Feb.

What action can I take ? I am very unhappy with the level of service and I thought a website could not take money from me until they had shipped the product ?

    Hi there
    I have had 2 dealings with pix mania both times to buy something that says it is in stock and as soon as you pay it says out of stock, Finally after waiting 45 mins to speak to someone they tell you a load of rubbish about them being in stock the nest day

    Get a refund this company are useless and all should stay clear

    don't think there is anything stopping them taking the money from you until they ship it however I would get on the phone to them and ask them if it's been sent because you certainly haven't recieved it!
    If it hasn't been sent then find out when, explain that you have waited etc and you need to have the item asap or you will cancel you order and they will need to refund you in full :)

    Pixmania have unfortunately got a bad reputation. Although I never used them myself, I just don't seen any benefit from using them, as I can get the products as cheap for else where, they ain't all that competitive in my eyes.

    I would email them telling them that it is unreasonable to expect this delay and that you would wish to cancel the goods with full reinbusement. Legally companies have up to 28 days to send goods unless they agreed before hand with you to send them early.

    Under the distance selling regulations you can cancel such an order any time in the period between the time order is placed and seven days after you have received the item.

    I never realised Pixmania had such a bad reputation. I've e-mailed asking for the order to be cancelled and for a full refund.
