Advice Please - Buying house off Mum

Hi all,

I currently live in a house in my mothers name. Basically last year I didn't get my mortgage in time due to a problem on my credit file so my mum put it in her name.

Due to various reasons I would like now to transfer ownership to my name. However, I would to know what fees etc I can escape..

I.e. Can I avoid majority of legal fees? Will searches etc have to be done again even though they were done a year ago and I have access to those searches? What are the legally required documents in all?

If I do have to get all the work done again I am hoping to strike a deal with the solicitor but any advice would greatly appreciated as I'm already having to cover 2000 redemption fees.

  • Most of the searches that a solicitor does are time bound. For example they will check for bankruptcy which will only be valid for a month (guess?) as you can be NOT bankrupt one day then bankrupt the next. The other searches will be similar so my guess is that there is no way they would be valid for a year.

    It will be classed as a sale and as such stamp duty will be in effect, if it over £120K.
