Seller trying to deceive me?? (v long)

Im a big fan of NEXT childrens clothes hence Ebay is like Aladdins cave for me. I purchased 2 sets of dungarees (9-12 months) from 2 diferent sellers. They both arrived today. One was perfect and the postage was priced well. (£1.49 for 2nd class recorded, i paid £2.20), however .....
the other dungarees set came in. I won it for 99p. I was a little disappointed at the postage charge but understand that sellers have to cover wrapping, their time etc. I paid £2.15 for 2nd class postage that actually cost 83p. The item arrived in an outsides in bag taped with a little bit of brown tape. I dont mind this, the bag seemed strong and i am all for recycling packaging. I recycle Pampers boxes etc when i am selling but that is because i keep postage costs down to the bare minimum for my buyers. What hacks me off a little as Paypal told me that i needed to get verified when i won this item, i had reached my limit so to save getting a neg for slow payment i sent the buyer a postal order as they didnt take cheques. So my item cost me
99p - bid
£2.15 - postage
30p - stamp
50p - postal order
Total - £3.94
When i opened the item the dungarees were in perfect condition but the matching vest looked a little small. The vest had the same pattern but upon measuring it up against my daughters vests (also from NExt and with sets) it was way too small. I looked at the neckline but the tag had been cut off, this wasnt mentioned in the auction. I dug out some old NExt sets and measured the vest up against a 3-6 month one and it was a perfect size match. I had a look at the auction listing to see if i had missed something about the size or the tag and to my surprise the picture shows the vest with its neckline tag so the seller has obviously cut it off.
What do i do next?? I want to send a ranting email to her and neg her like mad but is there any way of recouping my money?? I dont want to be paying for an item that doesnt fit my daughter. She has already left me positive feedback which is a boost :rotfl: but upon looking at hers she has had 2 negs in the past month.

Have you tried to email the seller? would you have still bought the item if you knew the vest would be smaller!? you can always buy vests for such small money, it is the dungerees that is the expensive item.
I wouldn't get yourself worked up so much about it! £3.94 is a good price for a next outfit! and not enough to get too annoyed about! especially if you like the other product!
If the seller knew it was smaller then they are being naughty!
I sold a pinefore dress with a matching top, the dress was in perfect condition but the top had a small stain which you wouldn't see under the dress, I just stated int he auction this and that it is the dress you are payin for and I am gonna pop the top in for free unless you state you don't want it!Angel0 -
The other next outfit was from another seller, sorry if i wasnt clear. The thing is that i bought it as a set, i wouldnt have bought them seperately as you sometimes see them on Ebay as i am quite fussy like that. The vest means just as much to me as the dungarees as it doesnt have that bits that normal vest have at the shoulders so if needs be i can use it with a dress or another pair of dungarees.
I wouldnt have bought the item if i knew the vest was smaller, my daughter grew out of 3 - 6 month clothing when she was 4 months old, that was 6 month ago! The vest was floral to match the pattern on the dungarees, it wouldnt have been so bad if it was plain as i could have replaced it but i cannot get another one of these to fit and match.

Also remember you paid £3.14 and not the £3.94 as it was your choice, for whatever reason or problem with paypal, to buy a PO and send it first class.
If you feel you have been misled by the seller then in the first instance email them politely and explain that the top appears to be a size smaller than stated and is not suitable. The seller may well offer a partial refund at that point which would be an excellent result.

I didnt hear back from the seller til today. She told me that it was bought as a set and my child maybe longer than hers. I explained that the vest is around 2 inches shorter on the length and the arms compared to the dungarees. She also told me that she cut off the tag on the vest when she bought it although the photo clearly shows the vest with tag. I pointed out that she said in her returns policy that "Items sold as seen", she doesnt do returns. I bought the item in the understanding that it was the correct size. I then told her to take a look at the listing and she told me that what i was seeing was a little bit of the tag that was still left on the vest, the tag sticks up in the photo but the way she has cut it there is no way that the tag sticks up, there is less than 1/2cm of it left.
I didnt have the chance to reply back to her at the time but i checked my inbox and she has sent me a message saying that she will refund me 33p. Do you think that this is fair or am i just being fussy?

Yes, I think you're being fussy ( I could think of another adjective ).
The thing only cost 99p !! Ignore postage etc since you knew the costs before you bought, so that's irrelevant...and it's hardly the sellers fault you had to send a PO.
Your child was too big for 3-6 month age clothing by the age of 4 months......so why would you even bother buying clothes to fit 9-12 months when the child is 10 months at least ( going by your info)?? There was always a risk the clothes would be too small......and the seller has offered you a 1/3 refund which is the best you can expect really.
Can't help thinking you'd be better off putting it down to experience?
And if the fact the seller has two negs in the last month is so important..why did you buy off her in the first place?if i had known then what i know now0 -
I think that because it is such a small amount you should just leave it! although I would be bristling at the principle of it and can now see where you are coming from! if it was £10 I would argue all the way but you may have to bite your tongue and put it down to experience! I would still be as nice as pie to her until you get your positive then neg her. this is not unfair as she is taking the mickey out of you.

Her growth has slown down now, she has started cruising and crawling, she has been in 9-12 months clothes for a while now and they still fit her with room. 99% of her clothes are from Next so i know what size fits her, there was never the chance of it being too small for her.
The sellers negs referred to the way she deals with her customers when they have a problem, not sending out goods that are not as described!I would be bristling at the principle of it and can now see where you are coming from!
Thank you, i couldn't really care less about the money, its the whole principle of the thing. She has tried to deceive me then tried repeatedly to lie her way out of it even though the listing photo is proof that the tags weren't cut off the outfit when she bought it.
If she had just said for a start when i bought it, "sorry but i didn't notice the size on the vest, do you still want to buy it ...." or words to that effect then i would have understood and im sure we would have come to some sort of arrangement quite easily.

The seller offered you a 1/3 refund.................. and she left you a positive feedback.
FGS if you want to neg her ...just do it and hopefully you'll feel better ( but how anyone posts a " nicely worded neg " is beyond me...and don't forget she can respond to it...informing people she offered a partial refund etc) .Like angelcake said....if it was £10 it would be worth arguing over......... but 99p???? :-/

She left me feedback when she received the postal order which i found a little strange, most sellers leave it after you have given them theirs, she maybe didnt anticipate that i would notice how small it was. I will wait and see if i hear anything more from her before i neg her. I know it maybe sounds cruel to you. I've never negged anyone before but she was very dishonest which is not on.
