Direct Debit problems with Natwest

Hi all,

My husband & I took out a joint personal loan in July 2008, and on the same day set up a joint back account. The first payment for the loan could not come from the joint account, so was set up against my own account. We then amended the direct debit by visiting the branch after the first payment was taken.

Since then, we had amount 5 months of the direct debit still coming out of my own account, and as my wages are paid into the joint account we opened in July 2008, this was making me overdrawn ask time. We visited & called the brand several times each time this occured and they said that they couldnt understand why it was happening, but each time they made amendments and promised it was fixed, and when we had a meeting with them in Oct/Nov they then put this in writting to us.

For the next few payments, it was sorted and the direct debit came out of the correct account. But for Feb's payment, the problem has returned.

Contacted the bank, and they couldnt have been less interested. Said they would re-adjust it, and set up an overdraft on my account to cover the loan should it happen again- I am not happy that that is an acceptable resolution.

The only way round this that I can think of is closing the loan account, and setting up a fresh loan- but I am concerned about what this will do to our credit rating, and there is no guarantee that it will pass or be the same rate.

Thoughout this episode the bank have assured that these payments which are making me overdrawn will not affect my credit rating, and they have refunded the charges each time. But I am really losing my patience- the constant calls & visits to the branch were frustrating enough last time, and it is seemingly starting all over again..

Is there any redress open to me?
