    2yrs prior to looking after my mother i had a work related accident to which i was off work for 6months due to being in hospital/recovery time, once you get a claim for the accident the goverment take back the incapacity allowance i got while off work recovering.

  • With the passage of time I doubt they'll prosecute now. But they will take action if you stop paying the debt or start acting unreasonably. And it is unreasonable to reduce your repayments if you have substantial savings.

    Try to keep up with the repayment arrangements you already have in place. If you have savings you have no need to reduce your monthly repayment, if anything you should consider paying the debt off faster.

    that is what i want to do , i want to pay this off in one go but not if they are then going to prosecute me , so i need to know how i go around setting this up , tried phoning up their debt management team in trafford who are dealing with it but they say to just keep monthly payments which are going to take me 6yrs to pay back. as for savings its 2x £3000 isas n a top up from father to whom id pay back .

    I dont see why they would prosecute you if you paid the debt back early unless you have lied about your savings in the past.

    The overall loss to public funds is one of the factors the fraud officers consider when they're deciding whether prosecution is appropriate. They would have looked at this whole issue 3 years ago when the overpayment was calculated. Given that you've repaid a substantial part of the debt I honestly don't think prosecution is now an issue.

    Salford advise to keep up the repayments, that's what I suggest too. If you can afford a bit more all well & good, how much extra you pay & when is entirely up to you.

    You're fretting unnecessarily.

    I have tried to find how to start a new thread but without success! Sorry all!
    I have a problem connected to DWP however, so perhaps you can help me here.
    33 years ago my husband left me and our children and I claimed benefits. About 14 months later he returned and stupidly I continued to claim - however he was not claiming or working so if he had claimed we would have got more.
    They took me to court and I was ordered to pay a large amount of money but I don't think it was all of it - probably due to the fact he had not been there all the time. It was terrifying and this was in 1978, over 30 years ago.
    I worked all my life and DWP and inland revenue always knew where I was.
    I am now on state pension and just found out they have been stopping £30 a week from my pension (did not notice at once) and it is because they reckon I still owe them £500 from 1978!
    Can they claim it after all this time?
    I thought that after the court case and me paying the court order that was the end of this, can they still claim from me?
    Help would be gratefully received and sorry I could not find how to start a new thread
