paypal dispute

Ive had a bit of a run in with a seller and could do with some opinions,

Purchased some boots described as 'brand new never worn'

They arrived in a good condition but clearly used, im not in the habit of buying used boots so was a bit disappointed. Contacted the seller who suggested this was from trying on in the store ??:rolleyes: so I emailed back a photo to show the clear wear to the soles, (the tread is gone in some places and the heal tip is scuffed)

They have suggested that I return the boots and they will refund me the purchase price of the boots - not the original p+p aswell, so i will be around £11 out of pocket :mad:

The last message told me to leave them alone as i wasnt being fair or making constructive comments :confused: after I had said I will not return the boots and be out of pocket when they are to blame.

Ive started a paypal claim but would like some advice on how things go from here, Ive paid £17.05 total and have requested £4 back.

    firstly is it just a dispute that you have raised, or have you escalated it to a full claim?

    have you requested £4 as a part refund? i would personally want to return for a full refund but anyway, its a long time since i did a claim for a part refund. i think they will ask the seller if they will agree to the £4 and they get 10 days to reply, if they disagree it will go to paypal to decide what to do, if they don't reply then i think they will automatically refund you what your asking for.

    if it goes to paypal then i personally think they will find in your favour, they will then ask you to return them to the buyer at your expense by a trackable method and upon confirmation of delivery they will refund you the item cost plus the original postage you paid.

    i would also leave the seller negative feedback, they sound awful!
  • thanks its a full claim now, ive requested £4 as a part refund to keep the loss down on both sides. I do like the boots so will just get them re-heeled but obviously this wasnt factored into my original bid.

    The seller hasnt been very helpful and has suggested that they were in fact perfect when they left them and ive added the wear to them !
