Consumer Rights/Secondhand/Amazon-Marketplace Sellers

Hi.
Recently i purchased an item from a Amazon marketplace seller. The item was a gift and it arrived late and damaged.
Item was a secondhand used tape cassette. and the tape box had a crack in it. When buying item. I read the description of item and there was no mention of damaged to tape box. When asked about damage. The seller states item was sent out undamaged and blames RM. The crack looks old + there is no sign of marks or footprints on the Jiffy envelope. Which you would need some kind of pressure to crack a tape box.
Anyway due to the tape arriving late and damaged. This seller has done everything they can not to take back item. The latest saying they have claimed for the damage from the Royal Mail and received stamps to the value of £2.16 which seller has refunded me. I personally would like a full refund for item + P+P i paid. And seller get the item back and the £2.16.
What are my statutory rights returning damaged second hand goods.

I'm not calling anybody a liar... but last time I made a claim through Royal Mail for damage, they refunded me the cost of the item that my seller paid, plus the cost of the postage... in cash. I had paid for postal insurance though so I don't know if it works differently if you haven't got that insurance.0

Can you not dig out another box?
Perhaps the crack was there before but you have already received back £2.16, how much was the item?
Personally I think you are making an issue out of this.

In fact the more I think about it why are you being totally unreasonable? You can by a blank tape for 59p at Richer sounds and that will give you box.
Have you copied it now and are just wanting to return it? :mad:0 -
