Hi Milliejon
not an expert on this but wanted to bump it back to the top.
try not to worry too much, we have had several cards from creditors which have amounted to empty threats0 -
Thank you adl65. I'll be content for a while once the postman as been this morning, and doesn't leave any nasty letters for me. I can stop worrying until Monday morning.
The machine is still taking messages, but no unwanted calls since Wednesay pm.DMP mutual support number 174Total debt now (April 10) £0! - total paid off £30,221 or 100%I'm now debt free after 6 years!!:jNon smoker since June 2006 :j0 -
After all this time, I've just returned home for the day and found a bill from Link Financial asking for the same minimum payment as the debt I suspected this was linked to. However, they don't acknowledge what it is for and neither have I heard from the original company I owed the money to.
Link are looking for the payment by 6 April. I will have the money, but I'm worried that if I pay them then I could get in trouble with the original company. I thought that I should write to Link asking what this is for, and then wait for them to reply before paying and continue to pay my original debtor.
Should I do this, or should I just assume Link are the people I pay? If so, should I write to my original debtor and get cross about not being advised about the change in owner (which is a breach of the OFT guidelines I think?) The trouble with this is that I don't know if Link are just administering the debt or if they've bought it.
Anybody have any thoughts please?DMP mutual support number 174Total debt now (April 10) £0! - total paid off £30,221 or 100%I'm now debt free after 6 years!!:jNon smoker since June 2006 :j0 -
Do not contect them, it is illegal for them to contact you via postcard according to OFT rules, just ignore it, if they pursue it then hold that agaisnt them if you can but DO NOT contact them0

Thanks Scottmu65, but I've now had a bill from them. Can anyone else offer any advice please?DMP mutual support number 174Total debt now (April 10) £0! - total paid off £30,221 or 100%I'm now debt free after 6 years!!:jNon smoker since June 2006 :j0

So the only way you can link Link to the Capital One debt is through the minimum payment figure?
You've had correspondence with Cap One and got a 12-month agreement from them. Your options are either to ignore Link and pay Cap one or contact Cap One and ask them if the've sold the debt or appointed a collector. Contacting link is a third option, but not one I'd take yet.
Ther's no mention on Link's letter of an 'original creditor' or a matching reference number?0 -

But if I do this won't Link say that I've missed a payment (as I suspect it will go past the payment day? What about if I write to Capital One and copy the letter to Link? You've had correspondence with Cap One and got a 12-month agreement from them. Nothing at all other than the payment amount.Ther's no mention on Link's letter of an 'original creditor' or a matching reference number?DMP mutual support number 174Total debt now (April 10) £0! - total paid off £30,221 or 100%I'm now debt free after 6 years!!:jNon smoker since June 2006 :j0 -
Writing to Cap One sounds like a good idea. I'm not sure I would write to Link at this stage. Give Cap One the opportunity to say 'we've not passed the debt to anyone' if that is the case.
You're still paying under the agreement to Cap One. Link can't say 'you've missed a payment' when there's no evidence that you have a legitimate debt to them.
Really you should not have to be making the running here.0 -
Thanks Fatbelly. The rebel in me thinks "What the hell - ignore Link", but the worrier in me is, well frankly, worrying about ignoring them.
Today the rebellious argument is winning. I think I shall ignore the letter, and continue paying Capital as arranged. I think what you're saying is that it really is between the two of them to contact me.DMP mutual support number 174Total debt now (April 10) £0! - total paid off £30,221 or 100%I'm now debt free after 6 years!!:jNon smoker since June 2006 :j0
