    Thank you to everyone. I'm a bit worried about not signing the letter, because I've done this in the past, and have been asked to send another letter signing it because they couldn't deal with the issue without a signature.

    I've got a feeling I know what debt this belongs to so shouldn't image that I'll be disputing ownership, but if they get difficult I'd like the option to ask them to produce my agreement.

    I'll send it today without a signature and see what happens.

    Skint-Chick - I hope your hubby gets things sorted. This kind of thing really throws me off course - it affects everything in my life! Grrrr!

    Just a quick update to let you know that I've posted the letter and used Recorded Delivery. Just terrified of the response I'm due now. Taking my worries out on the kids and hubby. I know I shouldn't but ......

    Milliejon - there's nothing to be terrified of here.

    Please read around on this board and understand how highly Link and the rest of the DCA fraternity are (not) regarded.

    The most likely occurrence here is that Capital One have employed Link to collect on a load of accounts and yours is in there.

    When (if) they start pestering for higher payment, just send them a copy of the letter you have received from Cap One showing that there is an agreement in place till Sept 09.

    You'll give them an update if they're still engaged on the account in September.

    And be nice to your kids and hubby. It's Saturday night!

    Thank you Fatbelly - I hadn't thought to send them a copy of the letter from Capital One when it comes to it. Whilst we're sending letters back and forth, I'm still paying Capital One as they haven't told me not to. I hope that will be sent on to Link.

    My understanding is that both Capital One and Link have broken the OFT Guidelines, because Link have tried to trick me into calling them and Capital One haven't informed me that they've sold my debt on. Is that right?

    Yes, keep a copy of the OFT Debt Collection Guidance to hand and be prepared to point this out to them - section 2.2c for starters

    But my guess (I could be wrong!) is that your debt hasn't been sold to Link - they're just acting as an agent to Capital One.

    Their reply to your letter will tell you.

    An update as promised. The letter was received by them on 11 February, and whilst I was out yesterday we had missed a phone call with a withheld number. Today my hubby took a phone call from Link asking me to call them. I have no intention of calling them, and have suggested that my hubby lets the machine take the calls again.

    I think I'll wait a week and then send another letter asking them to stop calling and to put what they want in a letter (again). Is that appropriate?

    Also, I read somewhere that the reason they want me to call is because Capital won't have been able to share my information with them (because of Data Protection Act), and they need me to confirm everything. Is this right?

    The reason they want you to call them is so they can pressurise you, threaten and lie, so that you increase your payments.

    If they've got anything important to say, they can put it in writing.

    I have taken a look at the OFT's Consumer Credit Act database tonight and Link Financial's licence expired last May. The application for renewal was put in, but is pending. What does this mean?

    Also, I can't find them on the FSA database. Should they be there?

    Just an update - we haven't received a call from them today. May be they are acting on my letter to only correspond in writing? I don't know if I'm more worried now or not. I just want the end of all this.
