Hi, i am hoping someone might know where I can try for help,as i am at my wits end.
i have been in reciept of Incapacity ben since 1999, and to cut a long story short, in november 2007 i saw a dwp dr (atos) and he declared (through some lies) that I was fit for work, I appealed, and went to tribunal in April 2008, where I was awarded My Inc ben back, with help from My consultant.
Then in November 2008 i get the dreaded IB50, so I rang the DWP and said "look, i have only just been given this back through appeal, do i really, have to go through this again?" They said yes, you do, as does everyone EVERY 2 YEARS, but it hasn't been 2 years!
Anyways, once again I have been called for a medical, even though i sent my consultants letter off with my IB50, so again I rang them and said "IF i am deemed fit for work by the atos dr, I will go to tribunal, AGAIN, and more than likely win, AGAIN, as my conditon is actually worse now, so this is all a waste of public money" lady at the DWP agreed, but said it had to be done, agggggghhhhhhh,
What a nightmare.
Is there a higher person I can appeal to, or are the robots at the dwp excatly that, robots??
I KNOW its not their fault, but I am so fed up.......

sorry to hear about your problems, but its a lie to say that everyone has to complete an IB50/have a medical every 2 years,it can vary from 1year to 5 years(sometimes even longer)it depends on the medical condition and within what time span they expect you to recover,or not recover as the case maybe.
Unfortunately theres not alot you can do other than go through the process yet again, you say you saw an atos doctor in november 2007,when exactly did you return the IB50 prior to that, the reason I ask is that there can be quite a gap and it may well be approaching 2 years since your last IB50???0
