Seller wont send replacement item until i've closed dispute?

I'm a bit confused..

I bought an item 27th dec and haven't received it. I opened a dispute with paypal after 8 days as seller has lots of bad feedback/lots of good too but started to get worried.

I got an email to say wait 15 days for RM delivery.. i did, no sign so i then said i wanted either a refund or a replacement as i need the item asap.

The seller said they'd send a replacement by recorded del if i closed the dispute as 'the system wont allow dispatch'.. this is a bit odd isn't it?

Surely, the dispute is not over until i've received the item and if i close it i probably cant re-open if this doesnt arrive?

I haven't raised it as a claim yet but im tempted to as i feel like somethings wrong.. any advice appreciated.

    Upgrade to a claim and don't take any more nonsense and then leave appropriate feedback after you win dispute.

    Is he pulling my leg with this system thing then? i thought so..

    If upgrade to a claim does that mean i have to wait for paypal to investigate as i really need this item and i think he might be the only seller on ebay to sell them :(

    I've put it up to a claim and hopefully they'll either send it or refund.

    DO NOT CLOSE THE DISPUTE!!

    If you do then the seller has you over a barrel and there is a good chance that you would not see a replacement or a refund! Let the dispute run it's course.

    You only get one shot at a dispute, so do not close it until you are happy with the goods that your receive - providing you do recieve them that is.

    If you close it now, and then receive a lump of wood in the post next week, there is nothing mroe you can do, and you can not open a second dispute if the seller goes back on their word. Given what they have said so far, I would not have much faith in their words.

    Even if he is the only seller of that item on ebay, your chances of getting the item from him are close to zero.

    Whatever you do, don’t close the dispute no matter what he says or promises.

    Escalate it to a claim now.

    Unless he send you the item or refunds your money, Paypal should refund you.

    That was my thought too... what if he sends something else in the post..

    I can't open it before signing can i?

    I hate ebay for this reason. Wish it was as easy as going to the shop and actually getting what you pay for :(
