Seller changed their mind about refund after I returned the item

I bought a Corsa doll from eBay which was described as new in the title. When received the tags were in poor condition and when squeezed it didn't speak.

I asked for a refund as it was not as described and the seller replied saying it was never described as a talking doll therefore no refund. However it is clearly not a new product if it does not talk as it has run out of batteries and the tag about the sound has been removed.

I orignally asked for a refund plus postage to return the item as I didn't want to be out of pocket. This would be £12.00 (£8.00 item, £2.00 postage each way). The seller said only £10.00 would be refunded which I agreed with and returned the item.

The item was received by the seller on 5th January according to Royal Mail so I went on Paypal and requested a refund of £10.00 to close the dispute. The seller offered a refund of £8.00. I clicked the take action button and rejected this amount and then the seller sent a message back saying '[FONT=arial,sans-serif]Fine if you won't cancel the transaction I can now not claim the final value fee. Therefore I will not offer the refund. I will offer a £9 refund.'

Is this right? Can I still get the £10.00 agreed? The message from the seller saying the refund is £10.00 was an eBay message so I still have it.

I'm scared about leaving a negative for the item not as described and the attitude of the seller in case I receive negative in retaliation.

    Firstly don't be worried about leaving f/b, that is the last thing to think about, getting your refund if the first thing.

    Also sellers can no longer leave negative f/b.

    A seller is not obilged to pay for return costs, although a good seller would.

    You are entitled to the £10, Paypal will only refund you the amount of the original transaction.
  • Update, the dispute has apparantly timed out. What do I do now?

    Phone paypal and talk to them. It has worked wonders for a couple of other people on here so far this week.

  • I called Paypal (using 1899 as their contact centre is in Ireland) and they said there's nothing they can do.

    I'm so mad, the seller is now ignoring eBay messages and I have now ended up paying for the item, the postage and the postage back to the seller!

    What can I do, this is a power seller so he must be registered as a business right?

    Do I have any rights at all?

    if i was you, i will accept £8 refund and left a negative. it is better than nothing anyway.

    Accept the refund, leave a negative saying "item not as new, seller refused full refund after item returned", and name and shame the seller on here!
