Possible Closure of Estate Agents That Is Listing My Property, Whats My Rights

Morning folks, I am looking to see if anyone can answer a wee query I currently have.

I have listed my property with an Estate Agent based in Scotland, but has branches nationwide and has been on the market for around 2-3months with no viewers. My brother's girlfriend's Aunt works for this particular Estate Agents (not naming names as yet) and indicated to her niece during general conversation over christmas that she expects this Estate Agent to close during 2009 due to the lack of properties selling, hence not remaining a viable company.

I have paid a listing fee of around £230 to put it on the market with obvious further fees after the hopeful sale of my property. Should this company cease trading, can i ask for a refund of my listing fee as they have failed to sell my property due to them closing the business? or can I withdraw my property from them before they close and list with someone else and request a refund of my listing cost as they have not managed to sell my property?

Also, if they did close or I did have to list my property with another Estate Agents, would I be required to have a House Report done, bearing in mind I listed my property before the 1st Dec 2008 deadline. I am not sure if listing with another party would mean I am 're-listing' therefore require a House Report to be carried out.

Any help would be appreciated!!

    What does your contract with them say?
    And the chances of getting money out of them is slim if they're in trouble,
  • Yea, I really should read the contract before I posted.lol...I was just wondering if anyone knew to be honest.

    By the way, its quite a large Estate Agents, well certainly in Scotland it is, so its not just a small back street company...not that it would make much of a difference.
