stolen cheque

Sold a plant in early December after buyer sent cheque, he emailed to say cheque in post so sent goods after banking. Now got cheque returned as he reported it stolen. As I have already given feedback can I still do a NPB if he does not reply satisfactorily? Its only £8.00 but I expect that's as far as I can go, apart from going to his house and breaking a few windows. (just joking before Andy or Conor get started)

Yup, just sent him an email before posting here. Not really expecting a reply but it might possibly be a genuine case of chque book stolen and a blanket stop put on all in the book (new book as number of cheque 0028, lloyds books are 25 thick)I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

I would never post anything until after a cheque has cleared and cant be reversed. Hard lesson here learn t here, I would not be so trusting in future.
Might be an error on the buyers part by some small chance and he might repay but in future do not post without receiving cleared payment.No you're not a vegetarian if you eat any animal or fish, so do not insult genuine veggies by calling yourself one! :mad:

While it is not illegal to stop a cheque, it is a criminal offence to hand over a cheque with the intention of stopping it later, although this can be difficult to prove. If someone pays for goods or services by cheque and then stops the cheque, court action can be taken against her/him for the money owing. Court action can also be taken even if a person does not owe any money, for example, if s/he returns the goods s/he has bought and stops the cheque.0

Problem is a cheque can be reversed even if its been "cleared"afaik it can be up to 6months, unless the new bank regs changed this. For an amount like this a small amount of trust is in order, this time it turned around and kicked me in the butt.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

How long was the cheque in the system and which bank. If it is one of the banks that use the 2-4-6 guaranteed clearing system and it was in the system for longer than 6 working days insist the bank cover the loss themselves.

The 2 -4 6- rules explained here:

The essence of these timescales is called the “2-4-6” rule.- • Two days after paying a cheque into a bank the customer should start earning interest on the money deposited. This is called Cleared for Interest.
- • Four days after paying the cheque in, the customer should be able to withdraw the funds. This is called Cleared for Value.
- • Six days after paying the cheque in, the customer can be certain the cheque will not be bounced. This is called Cleared for Fate.
Also if I read the next bit right all banks unless outside the geographic confines of the UK mainland have to adhere to this rule
The Impact on Clearing Banks Directly
There are 15 Cheque Clearing Banks in the UK ( click here for the list ). They are the core of the cheque clearing process and provide cheque clearing services to the 400+ other banks in the UK. For them there will be little impact of these measures. Sussed it, the bit from the bank saying stolen cheque was the problem. The customer put December on the cheque and not November. Partly my fault for not noticing this I suppose but I wanted to get the plant off before the xmas rush.
Will get customer to send new cheque.
