Business Lease in BR

Help - this ones complicated.

We have a limited company which we are going to cease trading at end of jan and then apply for strike off after the 3 month period as we can not afford to pay everyone and can't afford the 6k to go into insolvency.

We have signed personal guarntor on a 10 year lease at 22k per year which we have approk 7.5 years left.

Can we include this in the BR even before the landlord starts pursuing us for whatever he wants or do we have to wait for him to start pursuing us.

We don't want not to include it in BR as we could be liable after br application?

Does this make sense? Please help

    Inform company house you are no longer a director/secretary of the company and walk away, it will get struck off in due course

    Its a debt, cant see why not if you are going BR

    just notify company house officially

    be warned, if the ltd company has debts and YOU try to have it struck off the creditors can oppose it whereas if your no longer a director/secretary it makes no difference.

    if you were a PAYE employee of the company too, give yourself a P45 as well......

  • So I can just say to companies house "hey I'm no longer a Director and neither is my hubby" so that leaves the company with no directors?

    I am a little confuse, could you please explain some more?

    On companies house website there should be a form 288B which is for resignation of Directors, Complete, sign, post and job done.
