Paypal problems

Not sure if this is the right place to post this as I'm new here so my apologies if this is in the wrong section.

Anyway onto my paypal problem, my husband's birthday is coming up and every year he makes a list of stuff he'd like and I randomly pick from it(as well as get him some rather nice secret presents). He loves dvd's esp. films from other countries particularly japanese movies and on his list he had 4 movies in bold with the words please please get these for me, even if you don't get anything else I would love to have these...so how could I say no :)

I went onto the website, put the 4 movies in my basket and proceeded to checkout, paid via paypal and that was that. Fast forward 2 weeks to when they arrive(site is in america) and I didn't recieve dvd's I received very cheap pirate copies, I was sooo disappointed and mortified, it said nothing on the website about it not being a genuine dvd otherwise there is no way I'd have bought them.

I emailed the company and complained about the cheap copies and they had the cheek to get in a mood with me and rant on about how much it cost them to have the movies translated & subtitled, to which I told them I didn't care about that I just wanted my refund. They didn't reply so I filed a paypal dispute, still no reply to that so I emailed paypal and asked where I stood, they assured me I was covered and would receive a refund but should try to resolve it via the dispute but could escalate it to a claim. No refund, no communication so I escalated, the claim was closed straightaway automatically and I was told I was not covered, that paypal only cover you if the goods did not arrive(unless it's an ebay transaction).

So I'm stuck as to what to do, surely paypal should cover me as I what I received was not the same as advertised. I did try threatening the company by saying I would get the police onto them over the illegal discs if they didn't give me a refund(I was hoping to get a refund and then report them anyway) but they didn't even reply to that.

Any advice as to what to do next or should I just face facts that I've been conned and won't get my money back?

    Paypal only cover items sold and bought within the Ebay website. I've found this out the hard way as well when I bought a so called "working" mobile phone that turns out to be a complete duff one and the seller doesnt want to know. This was bought through Ebid and even Ebid dont want to know.
  • Ah, if it's not ebay then yeah, you might have a problem. Do you fund your paypal account with a credit card?

  • 13.12 What happens if I am unable to resolve the Dispute directly with the seller?
    You may escalate the Dispute to a Claim within 20 days of the date you filed the Dispute. PayPal will make a final decision for some – but not all – Claims. PayPal will generally make a final decision for an Item Not Received (INR) Claim, but will not make a final decision for a Significantly Not as Described (SNAD) Claim, or Claims involving Ineligible Items. This means that unless the seller voluntarily refunds your money, you will not recover any amounts for a SNAD Claim or a Claim for an Ineligible Item filed under the Buyer Complaint Policy.

    As someone posted above if you funded the purchase with a CC/Visa Debit card try asking the issuer for help
  • Thanks for your help everyone :) I fund my paypal with a credit card so will get in touch with the issuer see if they can help me at all. Hopefully they'll be able to do something if not then my hubbie had better really really like those films!
