Seller has confused me-what to do ??

Briefly, I bought something 15/12 and paid via paypal same day. Seller sent it out normal post 22/12. Item never received. I've e-mailed seller 3 times saying 'still waiting' etc and seller responded each time ( ie they seem completely legit ). I posted here about best option and decided on chargeback. Here's where the question comes. I e-mailed the seller yesterday and said I was going to do a chargeback and suggested she go for the Post Office refund ( she had the posting slip ). She was fine about it. I then did the paypal chargeback. Now I've got an e-mail message from her saying, she's had the paypal chargeback, she hasn't got enough funds in her account, can I cancel it and let her refund by cheque instead ?? I don't want to be difficult or unco-operative but I don't want to - I told her beforehand and she didn't say stop then, I don't KNOW if I can cancel it ( It's the first chargeback I've done ), I'm then having to trust her re a cheque refund, and I don't know if I can reinstate a cancelled chargeback if a cheque doesn't arrive ? I did my thing yesterday and don't what to spend any more time on this !!! I'm tempted to just e-mail her and say ' I can't stop it now ' an excuse, but thought I'd check out what other people thought.

    DO NOT cancel your chargeback as it cannot be restarted later. You have already given this seller ample opportunity to give you a refund voluntarily and i wouldn't risk losing out now.

    Most sellers would not have let this escalate to a chargeback situation and would have just refunded you once the item was obviously 'lost' the fact that she didn't, and now wants you to cancel the chargeback makes me suspicious.

  • don't take a cheque....what if that bounces?

    I have had this before and whent eh item has become 'lost in transit' I always make sure that the buyer is refunded the price that they paid. Just out of sheer courtesy.

    Stick with the charge back like soolin says, you cannot restart a chargeback and you will end up more disappointed in the long run.

    For low value items I just refund the buyer as soon as the item hasn't arrived and it's had a reasonable chance to be found in the post.

    Just say you can only accept paypal funds as that is how you paid as if you take a cheque you have got to pay it into the bank and wait for it to clear (providing it doesn't bounce) so you are wasting your own time if they try and send you a cheque, at least with paypal the money will be there in the account

    Just needed a bit of moral support and the consensus seems to be the same as my gut instinct. The item was only £ 7.00 incl postage, and this 'sorting out' seems to have gone on forever. Think I'll just stick with the way it is and pretend I didn't see the e-mail today.
  • If she has money in her cheque account why doesnt she upload some into her Paypal account. Also the chargeback will take at least 10 days so she has plenty time to get money in. As everyone else has said DONT cancel the charge back. You could give her the option of sending a Postal Order and tell her once you have the refund youll cancel the CB then but not on receipt of a cheque.

    You can play the same trick as her. Dont cancel the chargeback or answer any emails from her. Her paypal account will be frozen until she either instructs it to take money from her bank or enough funds go in the paypal account and she refunds you from them. Dont let her have any more chances as shes had plenty of time to give out a refund.
